![]() After the emergence of militancy, the J&K government frequently invoked the PSA to crack down on separatists.However, right from the beginning, the law was misused widely and was repeatedly employed against political opponents by consecutive governments until 1990.The law allowed the government to detain any person above the age of 16 without trial for a period of two years.The Act was introduced as a tough law to prevent the smuggling of timber and keep the smugglers “out of circulation”.The Jammu and Kashmir Public Safety Act (PSA), received the assent of the J&K Governor on April 8, 1978, and is often referred to as a “draconian” law.Instead, the authorities decided to invoke PSA.Following the completion of six months’ detention, continuing to hold them under the same law would have become untenable, though they could have been detained again after going through the motion of releasing them.They had been detained earlier, under Section 107 of CrPC.Both have been under detention since August 5, when the Centre tabled a bill to nullify Article 370 and 35A of the Constitution. ![]()
